Clutter Complaint Eviction Case Resolved Without Further Dispute
This week, our office represented a tenant in a holdover proceeding brought by their landlord, who alleged that the tenant had violated their lease due to “excessive clutter” in the apartment. The proceeding was brought following a notice to cure and a subsequent notice of termination, putting our client at risk of losing their home.
We appeared in court and conferred with opposing counsel and the judge to explore a resolution. Through negotiation, we were able to reach a settlement that worked for both parties. The lease and tenancy were reinstated, and the tenant agreed to follow the building’s house rules and allow for periodic inspections going forward.
The outcome was a win-win: our client remains stably housed, and the landlord retains a paying tenant.
This case is a reminder that with advocacy and open dialogue, even difficult disputes can lead to positive, practical solutions.
