Why an unfamiliar debt collector might sue you

If you are paying off a debt and one day, an unfamiliar person serves you with a lawsuit, it can be a daunting experience. How can you respond appropriately when you do not even know the basis of the lawsuit?

There are many possible reasons that an unknown creditor could sue you over a debt that you owe. Understanding the situation can help you prepare for the lawsuit and defend your rights.

Someone bought your debt

If you do not know the person who is suing you, it is unlikely that you ever signed a contract with them. The plaintiff must provide the court with a contract of sale that shows that they have bought your debt. Otherwise, they do not have good standing to sue.

Someone is confusing you with a different person

If someone steals your information and racks up debt under your name, you could end up dealing with a creditor who you never made an agreement with. A creditor might also sue you over another person’s debt because of a similar name, address or some other detail. In either case, you are not responsible for the debt.

You have been using another person’s card

Lastly, you could run into trouble with an unknown creditor if someone has authorized you to use their card. If you have not agreed to pay off the card’s debts, you do not owe the plaintiff anything.

As you can see, there are several ways that a misconception could lead to a debt collection case. However, by looking into the situation and figuring out what happened, you may be able to build a solid defense.
